Terms of Service

LawnNear.me is an online two-sided marketplace that connects homeowners and property managers ("Homeowners") seeking lawn care and related outdoor services with independent lawn care professionals and businesses ("Providers"). Homeowners and Providers are referred to collectively as "Users."

Providers are independent business owners who operate under their own name or business name — not under LawnNear.me's name — using their own tools, equipment, and supplies. Providers set their own rates and service areas. Providers may maintain their own clientele, offer services through other platforms, and accept or decline any service request. Providers are independent contractors of Homeowners; Homeowners are clients of Providers, not of LawnNear.me.

Any reference to a Provider being "verified," "approved," "live," or similar language indicates only that the Provider has completed our listing review process and met certain basic criteria. Such descriptions are informational only and do not constitute an endorsement, certification, or guarantee by LawnNear.me of a Provider's skills, licensing, insurance, or suitability for any particular task. Homeowners are responsible for independently evaluating Providers before engaging their services.

LawnNear.me is not an employment agency and is not an employer of any User. Users are not employees, partners, agents, joint venturers, or franchisees of LawnNear.me. LawnNear.me does not perform lawn care services, supervise Providers' work, set work hours or locations, or provide tools or supplies to Providers. LawnNear.me has no control over the quality, timeliness, legality, or any other aspect of the services performed by Providers. Each Provider assumes sole responsibility for all applicable tax filings, income taxes, and proper classification of any workers they engage.

By using the Platform, you represent and warrant that you are at least 18 years of age and legally capable of entering into binding contracts; will provide accurate, current, and complete information when creating your account; will comply with all applicable local, state, and federal laws; will not use the Platform for any unlawful or fraudulent purpose; and will communicate and transact with other Users honestly and in good faith.

If you are a Provider, you additionally represent and warrant that you are operating as a legally recognized business entity; hold and will maintain all licenses, permits, and registrations required by applicable law; carry adequate general liability insurance; and will only offer and perform services for which you have the necessary expertise and qualifications.

Providers pay a one-time listing processing fee of $29 at the time of submitting their listing for review. This fee is non-refundable once the review process has begun. Upon approval, Providers are enrolled in a monthly subscription plan at $49 per month, which includes a 30-day free trial. Providers may cancel within the trial period without charge.

All payments are processed securely through Stripe. By submitting payment information, you authorize LawnNear.me to charge the applicable fees to your payment method. The $29 listing processing fee and monthly subscription fees are non-refundable for any partial billing period. If you believe a charge was made in error, contact us at [email protected] within 30 days of the charge.

You are solely responsible for determining and remitting all applicable taxes on fees you receive for services performed through connections made on the Platform. LawnNear.me does not withhold taxes on behalf of any User.

Before initiating any formal legal proceeding, you agree to contact LawnNear.me at [email protected] and attempt to resolve the dispute informally. LawnNear.me will attempt to resolve the dispute within 30 days of receiving your written notice.

If informal resolution fails, any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You and LawnNear.me each waive the right to a jury trial and to participate in any class action or representative proceeding. You may opt out of the arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with the subject line "Arbitration Opt-Out."
